이용약관 (Terms of Use)

제1조 목적

본 약관은 라이징 스타즈 코리아(Rising Stars Korea, 이하 “회사” 또는 “플랫폼”)가 제공하는 소셜 네트워크 및 e스포츠 리그·토너먼트 관련 서비스(이하 “서비스”)의 이용조건과 권리·의무를 규정함을 목적으로 합니다.

제2조 약관의 효력 및 변경

1. 본 약관은 플랫폼에 게시하거나 별도 고지함으로써 효력이 발생합니다.​

2. 회사는 관련 법령을 위반하지 않는 범위에서 약관을 변경할 수 있으며, 변경 시 적용일자 및 변경 내용을 사전에 공지합니다.​

3. 이용자가 변경 이후에도 서비스를 계속 이용하는 경우 변경된 약관에 동의한 것으로 간주합니다.​

제3조 계정 생성 및 관리

1. 이용자는 본인의 정보로 계정을 생성해야 하며, 허위 정보 또는 타인의 정보를 사용할 수 없습니다.

2. 계정 및 비밀번호 관리 책임은 이용자에게 있으며, 제3자에게 양도·대여·공유할 수 없습니다.

3. 이용자는 계정 도용 또는 보안 침해가 의심되는 경우 즉시 회사에 통보해야 합니다.​

제4조 서비스 내용

1. 회사는 e스포츠 소셜 네트워크, 플레이어·팀 프로필, 리그 및 토너먼트 운영 도구, 경기 일정 및 결과 관리, 중계·방송 연동 등의 서비스를 제공합니다.

2. 회사는 필요 시 서비스의 전부 또는 일부를 변경·중단할 수 있으며, 이 경우 사전에 공지합니다.

3. 토너먼트 규정, 게임 내 규칙, 참가 자격 등은 별도 운영 규정으로 정할 수 있습니다.

제5조 이용자의 의무 및 금지행위

1. 이용자는 관련 법령, 본 약관, 플랫폼에 게시된 운영 정책을 준수해야 합니다.

2. 이용자는 다음 각 호의 행위를 해서는 안 됩니다.

   • 부정행위, 핵·스크립트·버그 악용, 고의적인 승부 조작 등 공정성을 해치는 행위

   • 타인에 대한 욕설, 비방, 혐오 표현, 사생활 침해, 명예훼손

   • 저작권·상표권 등 제3자의 지식재산권 침해

   • 불법 도박, 현금 거래, 사기, 해킹, 서버 공격 등 법령 위반 행위

   • 플랫폼의 정상적인 운영을 방해하거나 과도한 트래픽을 유발하는 행위

   • 회사의 사전 동의 없는 영리 목적의 광고·홍보 활동

3. 회사는 금지행위가 확인될 경우, 게시물 삭제, 경기·리그 기록 취소, 계정 제한 또는 영구 정지 등의 조치를 취할 수 있습니다.

제6조 사용자 콘텐츠

1. 이용자가 플랫폼에 게시하거나 업로드하는 글, 이미지, 영상, 경기 기록 등 일체의 자료(“사용자 콘텐츠”)에 대한 책임은 전적으로 이용자에게 있습니다.

2. 이용자는 회사에 대해, 서비스 운영·홍보를 위하여 사용자 콘텐츠를 전 세계적으로 무상·비독점적으로 이용·복제·변경·배포·전시할 수 있는 라이선스를 부여합니다.

3. 회사는 법령 위반, 약관 위반, 권리 침해가 의심되는 사용자 콘텐츠를 사전 통지 없이 삭제하거나 노출을 제한할 수 있습니다.​

제7조 지식재산권

1. 플랫폼 및 서비스와 관련된 소프트웨어, 디자인, 로고, 상표 및 기타 일체의 콘텐츠에 대한 권리는 회사 또는 정당한 권리자에게 있습니다.

2. 이용자는 회사의 사전 서면 동의 없이 위 권리를 무단 사용, 복제, 배포, 변형할 수 없습니다.​

제8조 제3자 서비스 및 링크

플랫폼에는 외부 결제 서비스, 스트리밍 서비스, 게임사 API 등 제3자 서비스로 연결되는 링크가 포함될 수 있으며, 해당 서비스는 각 제공자의 약관과 개인정보 처리방침이 적용됩니다.

제9조 서비스 제공의 중지

회사는 다음 각 호의 사유가 있는 경우 서비스 제공을 일시 중지하거나 제한할 수 있습니다.

• 시스템 점검, 서버 증설·교체 등 운영상 필요

• 정전, 장애, 천재지변, DDOS 공격 등 불가항력

• 기타 회사가 서비스 제공을 지속할 수 없는 중대한 사유가 발생한 경우

제10조 보증의 부인

1. 회사는 서비스가 항상 중단 없이 제공되거나, 오류가 없거나, 특정 목적에 완전히 부합한다고 보증하지 않습니다.

2. 토너먼트 결과, 매칭, API 연동 데이터 등은 기술적 한계 및 외부 시스템 상태에 따라 지연·오류가 발생할 수 있습니다.

제11조 책임의 제한

1. 회사는 이용자가 서비스를 통해 얻은 정보, 다른 이용자와의 상호작용 또는 외부 링크를 통해 발생한 손해에 대해 법률상 허용되는 범위 내에서 책임을 지지 않습니다.

2. 회사의 과실로 인한 손해가 인정되는 경우에도, 회사의 총 책임 한도는 최근 3개월 동안 이용자가 회사에 실제로 지급한 금액 범위를 초과하지 않습니다.​

제12조 계정 정지 및 해지

1. 이용자는 언제든지 계정 삭제를 요청할 수 있으며, 관련 법령상 보관 의무가 있는 정보를 제외한 데이터는 합리적인 기간 내 삭제됩니다.

2. 회사는 약관 또는 운영정책 위반, 불법행위, 장기간 미이용 등의 경우 사전 통지 후 계정을 제한 또는 해지할 수 있습니다. 심각한 법령 위반의 경우 사후 통지로 갈음할 수 있습니다.

제13조 준거법 및 분쟁 해결

1. 본 약관은 대한민국 법률을 준거법으로 합니다.​

2. 서비스 이용과 관련하여 회사와 이용자 사이에 분쟁이 발생한 경우, 당사자는 성실하게 협의하여 해결하며, 협의가 이루어지지 않을 경우 민사소송법에 따른 관할법원에 소를 제기할 수 있습니다.​

Terms of Use (English)

1. Purpose

These Terms of Use (“Terms”) govern your use of the Rising Stars Korea (“Company”, “Platform”) social network and its esports league and tournament services (“Services”).

2. Effect and Modification of Terms

1. These Terms take effect when posted on the Platform or otherwise notified to users.​

2. We may modify these Terms to the extent permitted by applicable law and will announce the effective date and key changes in advance.​

3. Your continued use of the Services after the effective date constitutes your acceptance of the revised Terms.​

3. Account Creation and Management

1. You must create an account using accurate, up‑to‑date personal information and may not use false or third‑party information.

2. You are solely responsible for maintaining the confidentiality of your account and password and may not sell, share, or transfer your account.

3. You must promptly notify us of any suspected unauthorized use or security breach of your account.​

4. Description of Services

1. The Platform provides an esports social network, player and team profiles, league and tournament tools, match scheduling and results, and broadcast integrations.

2. We may modify, suspend, or discontinue any part of the Services at any time, with prior notice where reasonably possible.

3. Specific tournament rules, game rules, and eligibility requirements may be set out in separate regulations.

5. User Obligations and Prohibited Conduct

1. You must comply with applicable laws, these Terms, and all policies posted on the Platform.

2. You must not engage in any of the following:

   • Cheating, using unauthorized software or exploits, match‑fixing, or any conduct that harms competitive integrity

   • Harassment, hate speech, defamation, invasion of privacy, or other abusive behavior

   • Infringement of copyrights, trademarks, or other intellectual property rights

   • Illegal gambling, real‑money trading, fraud, hacking, or attacks on our servers

   • Actions that disrupt or overload the normal operation of the Platform

   • Commercial advertising or promotion without our prior written consent

3. If prohibited conduct is detected, we may remove content, void match or league results, and restrict or permanently suspend accounts.

6. User Content

1. You are solely responsible for any content you upload or post on the Platform, including text, images, videos, and match data (“User Content”).

2. You grant the Company a worldwide, non‑exclusive, royalty‑free license to use, reproduce, modify, distribute, and display your User Content for operating and promoting the Services.

3. We may remove or restrict access to User Content that appears to violate laws, these Terms, or third‑party rights.​

7. Intellectual Property

1. All software, designs, logos, trademarks, and other content related to the Platform and Services are owned by the Company or its licensors.

2. You may not use, reproduce, distribute, or modify such materials without our prior written consent.​

8. Third‑Party Services and Links

The Services may integrate or link to third‑party services such as payment providers, streaming platforms, and game publisher APIs, which are governed by their own terms and privacy policies.

9. Suspension or Interruption of Services

We may temporarily suspend or limit the Services in the following cases:

• System maintenance, server upgrades, or other operational needs

• Power outages, failures, natural disasters, DDoS attacks, or other force majeure events

• Any other significant reason that makes continued service provision impracticable

10. Disclaimer of Warranties

1. The Services are provided “as is” and “as available” without any express or implied warranties, including fitness for a particular purpose or non‑infringement.

2. Tournament results, matchmaking, and API‑based data may be delayed or inaccurate due to technical limitations or third‑party system issues.

11. Limitation of Liability

1. To the fullest extent permitted by law, the Company is not liable for any damages arising from your use of the Services, your interactions with other users, or your reliance on information obtained through the Platform or external links.

2. Where liability cannot be excluded, our aggregate liability will not exceed the total amount you actually paid to us during the three (3) months immediately preceding the event giving rise to the claim.​

12. Account Suspension and Termination

1. You may request deletion of your account at any time; data subject to statutory retention obligations will be kept only as required by law.

2. We may restrict or terminate accounts for violations of these Terms, unlawful conduct, or prolonged inactivity, with prior notice where reasonable; serious legal violations may result in immediate suspension.

13. Governing Law and Dispute Resolution

1. These Terms are governed by the laws of the Republic of Korea.​

2. Any disputes arising out of or in connection with the Services shall first be resolved in good‑faith negotiations between you and the Company; if unresolved, they shall be submitted to the competent court in accordance with Korean civil procedure law.​
